FOCUS Beat Your Screen Time Challenge
 
 

This Challenge is open to entrants aged 18+ only. The Challenge opens at 00.01 hrs on 06.06.2022 and closes at 23.59 hrs on 03.07.2022. Entrants who complete the challenge (the "finishers") will receive a digital "Beat Your Screen Time" badge and get the chance to win a FOCUS bike including bikepacking bags. By participating in the Challenge, all entrants will be deemed to have accepted and be bound by the full terms and condition. Registration for the raffle ends at 23:59 hrs on July 6th, 2022.

The Challenge

The FOCUS Beat Your Screen Time Strava Challenge ("the challenge"), is for Strava members to complete 28 hours of cycling within the challenge period. All finishers of the Challenge who subscribe to the FOCUS newsletter are given the chance to win an ATLAS 6.8 from FOCUS bikes equipped with ORTLIEB bikepacking bags worth € 550 by entering in their email address and opting in to accept FOCUS' Data Policy and Terms and Conditions as well as opting in to receive marketing communications from FOCUS Bikes.

The winner is chosen at random from the entire database of finishers who complete the challenge and subscribe to the FOCUS newsletter.

TERMS AND CONDITIONS

By entering the Challenge, all entrants will be deemed to have accepted and be bound by the terms and conditions and all entry instructions form part of these terms and conditions. These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

Eligibility: Natural persons who have reached the age of 18 are eligible to participate. Participation is not restricted to customers of the organiser. Should a participant be restricted in his/her legal capacity, the consent of his/her legal representative is required. All persons and employees of the organiser (FOCUS Bikes), the advertising partner (Strava) and their family members involved in the conception and implementation of the competition are not eligible to participate in the competition.

In addition, the organiser reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons, for example

(a) in the event of manipulation in connection with access to or implementation of the competition,

(b) in the event of breaches of these conditions of participation,

(c) in the case of unfair trading, or

(d) in the event of false or misleading information in connection with participation in the competition.

Entry: Entry to the Challenge is available upon use of Strava. The Challenge starts at 00.01 hrs on June 6th, 2022 and ends at 23.59 hrs on July 3rd, 2022. The Challenge starts and ends based on each user’s local time zone. All activities logged during the Challenge period must be uploaded to Strava no later than three days after the challenge ends.

No purchase necessary. 

Entry Period: Opens at 00.01 hrs on 06.06.2022, closes at 23.59 hrs on 03.07.2022. Participants need to register for the raffle on the FOCUS page until 23:59 hrs on July 6th, 2022.

All entries must be made directly by the person entering the Challenge. Entrants who do not give correct details will be disqualified, at the Promoter’s discretion.

No responsibility will be taken by the Promoter for entries or claims which for technical or other reasons are not entered correctly or are lost. Incomplete entries will not qualify for the Challenge.

Reward & Prize Information

Prize: Every person who successfully completes the Challenge and subscribes to the FOCUS newsletter has the chance to win an ATLAS 6.8 from FOCUS bikes and ORTLIEB bikepacking bags worth € 550.  He or she can choose between bike sizes XS, S, M, L or XL. The organiser expressly reserves the right to withdraw, amend or terminate the competition without prior notice if there are justified reasons, e.g. hacker attacks, attempts by third parties to manipulate the competition or similar. The winner must confirm his/her identity within three days after the first notification by FOCUS Bikes.

The winner will be drawn at random from all eligible entries. The odds of winning depends on the amount of entries received. In order to enter, ride 28 hours in four weeks, upload to Strava and subscribe to the FOCUS newsletter. Legal recourse is excluded.

Winner notification: Finishers will be notified by Strava upon completion of the Challenge period and directed to claim the prize via email.

Prizes are non-transferable and cannot be resold, or exchanged for cash.

The Promoter reserves the right to publish the name, photograph, likeness and county of the Winner or to publicise the Challenge or the prize-giving presentation, in any and all media that the Promoter desires, after the date of the Challenge close date and within a year of this date.

The Winner agrees to take part in such reasonable Challenge-related publicity as the Promoter may require and accepts that the Promoter may publicise images/statements in connection with/resulting from this Challenge.
In order to claim the the prize challenge finishers must enter their email address in to the reward form and accept FOCUS' Terms and Conditions and Privacy Policy.

The Promoter expressly reserves the right to terminate the challenge or change the challenge's time period without prior notice and without explanation. This shall apply in particular to any reasons that would disrupt or prevent the planned course of the competition.

The organiser is entitled to change the content of the conditions of participation during the term of the competition if there are important reasons that make a change necessary.

Our Right to Use Information About You

All personal data provided by the participants will be collected, stored and processed by or on behalf of the organiser strictly in accordance with the General Data Protection Regulation (2018) and the German Federal Data Protection Act (BDSG). The organiser points out that the data will be stored in the USA on servers rented or used by STRAVA; in the USA there may be a different, in particular lower level of data protection than in the EU - this is unavoidable for the organiser; the participant expressly agrees to the storage of his/her data in the USA by participating in the Challenge and transmitting his/her data.

The personal information will be used by or on behalf of the Promoter to enable it to administer the Challenge and publicise the Prize winners, and to send an entrant what he/she asks the Promoter to send him/her. The winner’s information may be shared in line with FOCUS' third party agencies in line with FOCUS' Data Policy and Terms and Conditions found at the bottom of this webpage.

An entrant’s personal details may be used for the marketing purposes of the Promoter only if an entrant has opted in to receiving future marketing mailings from the Promoter or for any other purpose agreed by an entrant. If an entrant would like to stop receiving messages from the Promoter, he/she can use the unsubscribe button provided in an email from the Promoter.

Other than its agencies and third party suppliers who are contracted to administer the Challenge, the Promoter will not pass entrant’s details on to any third party unless otherwise required to do so by law.

In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Challenge or the awarding of Prizes, the Promoter reserves the right to cancel or amend the Challenge or these terms and conditions, at any stage, but will always endeavour to minimize the effect to entrants in order to avoid undue disappointment.

The Promoter and its agents reserve the right at its sole discretion not to consider, and to exclude or disqualify any entry that they deem to be abusing or tampering with the operation of the Challenge, or to be acting in any manner deemed by the Promoter to be in violation of or inappropriate with these terms and conditions.

The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details and to refuse to award a Prize or withdraw Prize entitlement and/or refuse further participation in the Challenge and disqualify the entrant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this Challenge's entry requirements or otherwise where an entrant has gained unfair advantage in participating in the Challenge or won using fraudulent means. The Promoter will be the final arbiter in any decisions and these will be binding and no correspondence will be entered into in relation this clause.

This Challenge is not sponsored, administered or endorsed by, or associated with, Facebook, Twitter or any other Social Network or the producers, retailers or any other party featured in the Prizes. Trademarks, logos and names of any third party are the property of their respective owner.

The Promoter assumes no responsibility for:

(i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications;
(iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Challenge;
(iv) any incorrect or incomplete information which may be communicated in the course of the administering this Challenge (whether as a result of one of the foregoing causes or otherwise);
(v) any delay in delivery, or failure of safe delivery of the Prize.

Unless intent, gross negligence, injury to life, limb or health are concerned, as well as in the case of product liability, also regardless of fault, any liability is excluded. There shall also be no exclusion of liability in the event of a merely negligent breach of essential contractual obligations, e.g. special advisory or information obligations with which the contract stands or falls; in this case, liability shall be limited to the foreseeable damage typical for the contract. This limitation of liability applies not only to the organiser but also to its affiliated companies and agencies and their employees (the "relevant parties").

The Challenge and the terms and conditions will be governed by the German law and any dispute arising out of or in connection with the Challenge will be subject to the exclusive jurisdiction of the courts of Germany.

SEVERABILITY CLAUSE

In the event that a provision of these terms and conditions of participation is or becomes invalid, either in full or in part, this will not affect the validity of the remainder of these terms and conditions of participation. Any invalid provision will be replaced by the statutory regulation that is economically closest in meaning and purpose to the invalid provision. The same shall apply in the event that these terms and conditions of participation contain a loophole.
